Terms & Conditions
Please read these terms and conditions carefully before using our website or subscribing to our furniture rental and sales services.
1. Acceptance of Terms
By accessing, browsing, or using the website and services provided by Bard Furniture (“the Website,” “we,” “our,” or “us”), including but not limited to furniture sales, rentals, and subscription plans, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
2. Furniture Rental Policies
Term & Auto-Renewal: The rental period begins on the delivery date. Unless written notice is provided at least 15 days before the term expires, the agreement automatically renews on a month-to-month basis at the prevailing rate. Bard Furniture will provide automatic renewal notices where required by applicable California law.
Customer Protection Plan Fee & Billing: Bard Furniture does not require a traditional security deposit. Instead, a non-refundable Customer Protection Plan fee equal to 9% of the total subscription fee applies to rental subscriptions. Monthly rent is billed according to the customer’s delivery date and applicable billing cycle rather than a fixed calendar day. Late payments will incur a late fee of 10% per month on the outstanding balance.
Care, Use & Subleasing: Renters must use the items in a careful and proper manner. Subleasing, relocating the furniture from the original delivery address without prior written consent, or using the furniture for illegal purposes is strictly prohibited and constitutes a material breach of this agreement.
Damage, Loss & Theft: Normal wear and tear is expected. However, the renter is fully responsible for loss, theft, or damage beyond normal wear (e.g., burns, deep stains, pet damage, water damage). Bard Furniture reserves the right to charge the renter’s payment method the full cost of repair or the current retail replacement value of the item.
Early Termination: Early termination of a fixed-term rental agreement is not permitted unless Bard Furniture gives prior written approval. Customers remain responsible for the full agreed subscription term and all applicable fees.
3. Sales, Subscriptions & Payments
Pricing & Billing: All prices are in USD. We reserve the right to correct pricing errors and modify prices without prior notice. Subscription plans are billed continuously according to the selected billing cycle until canceled or until the subscription term ends according to the applicable rental agreement.
Title & Risk of Loss: For purchased items, title and risk of loss pass to you upon delivery. Until full payment is received, Bard Furniture retains a purchase money security interest in the goods.
4. Delivery, Inspection & Returns
Delivery & Failed Attempts: We will provide an estimated delivery window. If a delivery or pickup fails due to the customer’s absence or inaccessible premises, a rescheduling fee of $199 will apply.
Inspection Upon Delivery: Customers must inspect all items immediately upon delivery. Any defects, missing parts, or damages must be reported to our delivery personnel on-site or via email within 48 hours. Failure to do so constitutes acceptance of the items in “as-is” condition.
Returns & Restocking: Custom-made items and used rental items are non-refundable except as required by applicable law or expressly stated in our Returns & Exchanges Policy. Eligible rental returns or exchanges must be requested within 7 days of delivery and are subject to a restocking fee equal to 25% of the first month’s subscription fee, plus applicable return shipping, pickup, cleaning, or damage costs. Eligible standard retail purchase returns must be requested within 7 days of delivery and are subject to a restocking fee equal to 15% of the item purchase price, plus applicable return shipping, pickup, cleaning, or damage costs. Rental items must be in original, unaltered condition (normal wear and tear excepted), while purchased retail items must be in original, unused, unaltered condition.
5. Disclaimers & Limitation of Liability
“As-Is” Provision: To the maximum extent permitted by applicable law, all products and services are provided “as is” and “as available” without any warranties of any kind, either express or implied, including fitness for a particular purpose.
Liability Cap: Bard Furniture, its directors, employees, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the products. Our total maximum aggregate liability for any claim shall not exceed the amount actually paid by you to us in the 2 months preceding the event giving rise to the claim.
6. Indemnification
Indemnification: You agree to indemnify, defend, and hold harmless Bard Furniture and its affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your breach of these Terms, your misuse of the products, or your violation of any third-party rights.
7. Force Majeure
Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, strikes, or supply chain disruptions.
8. Governing Law & Dispute Resolution
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
Binding Arbitration & Class Action Waiver: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be resolved by binding arbitration administered in California, rather than in court, except where applicable law requires otherwise. You and Bard Furniture agree to waive any right to a jury trial or to participate in a class action lawsuit to the fullest extent permitted by applicable law.
